Auction Terms & Conditions

All property is sold "as is where is" and ALL SALES ARE FINAL. No refunds, returns, or exchanges. Property is open to thorough public inspection and it is the bidder's responsibility to determine condition etc.

Though all descriptions are believed to be correct, auctioneer makes no warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, condition, etc.

Item Condition: All items are sold in as-is condition. Most items in the auction are used and should be considered to be in moderately used/aged condition unless otherwise posted. Please note that the listed problems may not be the only problems that keep these items from being in mint condition, nor does the lack of any listed defects mean that the item is in perfect condition. All items could have minor scratches, loose components, age cracks, worn areas, and other blemishes. Some items may have been repaired/altered at some point in their life beyond our scope of knowledge and therefore would not be listed as such. Please look at the photographs of the item, give us a call, and/or visit in person during a scheduled preview time to inspect the condition of items that you are interested in to verify that they are in acceptable condition for you and your intended use of the item. It is advised to inspect these items in person to make sure they are in a condition suitable for your needs. If you cannot inspect in person, please bid accordingly for the unknown factors. Please inspect or research carefully to determine if the product meets the quality you are searching for. PLEASE BE AWARE THAT ALL SALES ARE FINAL

Item Inspection: All items are open to public inspection during designated dates and hours. Please see auction details for specific times for each auction. We encourage all bidders to carefully inspect auction items in person or send a representative to make sure that the condition, color, quality, etc. meet the bidders expectations. If a bidder or representative cannot come in person, please bid accordingly for the unknown factors. Please see item condition above.

Buyer's Premium & Sales Tax: ALL SALES are subject to a 13% Buyer’s Premium that will be added to the high bid. All buyers must pay sales tax at current rate of 8%, unless you have a retail sales license on file with us. If you have a resale tax license please email a copy to us at [email protected].

Payment & Invoicing:  The credit card on file will be processed up to $500.00 for a nonrefundable deposit on items won in the auction. Total invoice amount will include the bid price plus buyer’s premium and sales tax if applicable. Any remaining balance must be PAID in full on pick up day. ALL SALES ARE FINAL
Item Removal - After the close of the auction, auctioneer is not responsible for damage, theft, breakage, etc. Any items not removed by the pickup deadline will be considered abandoned property. JOHN T HENRY AUCTION., LLC. reserves the right to resell the abandoned items and retain all sales proceeds as payment for accumulated, unpaid storage and handling without notification to original purchaser!

No items shall be removed from premises without having been paid for in full.

JOHN T. AUCTION CO., LLC can assist you in locating items during scheduled pick-up times but DOES NOT provide transportation services for buyers to remove their merchandise. Any and all methods of lifting, towing, hauling and securing, as well as all other methods or requirements for the removal and transport of the items, materials, equipment and/or vehicles, is the sole responsibility of the buyer. If JOHN T. HENRY AUCTION CO., LLC Inc. employees do assist in loading of items, JOHN T HENRY AUCTION CO., LLC is not responsible for damage to the items being loaded or the vehicle, truck or trailer to which the item is loaded.

Shipping: Please respond to your paid invoice for shipping on the day of pickup. We ship through Carolina Services & Crating Company, LLC. Registration: By registering and bidding for the auction, you agree that you have read and agree to abide by all terms and conditions contained herein. via email.
Any bidder who does not comply with the terms and conditions will have their bidding privileges revoked!

Gun Terms and Conditions: All guns must be transferred, picked up, or shipped through our FFL, located at 2748 Cultra Rd. in Conway, SC 29526. There will be a $25.00 transfer fee per gun for the first 2 guns, after 2 guns there will be a $10.00 transfer fee per gun. Shipping will be available at the buyer's expense. Please have the FFL in your area to contact us for all transfers out of state.

TRANSFER LOCATION FOR NON-LICENSEE'S: JOHN T. HENRY AUCTION CO., is a federal firearms licensee. Before any firearm is transferred into your possession, you will have to fill out a 4473 and pass a background check. All background checks, transfers and related actions will have to be completed at JOHN T. HENRY AUCTION CO., located at 2748 Cultra Rd in Conway, SC 29526 – 843-365-2637.
